These Terms of Service constitute a legally binding agreement between the individual or entity using the services, referred to as “the User”, and Mohammed Naoufel Madih, operating as an Auto-entrepreneur under the brand Horizon Studies, with ICE 003618872000011, IF 66122168, and TP 36108324, referred to herein as “the Company”. By accessing or using any consulting, application support, or related services provided by the Company, the User acknowledges full understanding and acceptance of these Terms. Any User who does not agree with these Terms must immediately discontinue use of the services.

  1. Definitions

For the purposes of these Terms, the following definitions shall apply. “Services” refers to all advisory, administrative, consulting, or related services provided by Horizon Studies, including support for applications to universities and educational institutions abroad, student orientation, visa assistance, and other complementary services. “User” denotes any individual or entity accessing or utilizing the Services. “Personal Data” means any information relating to an identified or identifiable User, including but not limited to academic records, identity documents, financial information, and contact details. “Third Parties” or “Partners” refer to universities, educational institutions, testing centers, governmental authorities, or any other entities involved in the provision, facilitation, or execution of the Services.

  1. Scope and Nature of the Services

Horizon Studies provides advisory and administrative support in connection with applications to universities and educational institutions. The Company does not warrant or guarantee admission, scholarship awards, visa issuance, processing times, or any other outcome determined by third parties. All decisions related to academic or immigration processes remain solely under the authority of the respective institutions and governmental authorities. The Services are intended to assist and facilitate the application process and do not replace the formal requirements or procedures of the relevant institutions or authorities.

  1. Eligibility

The User represents and warrants that they are of legal age in their country of residence or have obtained the requisite parental or guardian consent to use the Services. By accessing or using the Services, the User affirms that they satisfy these eligibility requirements. The User acknowledges that the Company may request proof of age or parental consent where applicable and that access to the Services may be restricted in the absence of such proof.

  1. Responsibilities of the User

The User shall provide the Company with accurate, complete, and up-to-date personal and academic information and shall ensure the timely submission of all required documents. The User bears full responsibility for the authenticity, legality, and accuracy of all materials provided. The Company reserves the right to suspend or terminate Services where the User provides false, misleading, or incomplete information, or engages in conduct that is contrary to legal or ethical standards. The User shall also comply with all applicable laws and regulations in connection with the use of the Services.

  1. Fees and Payment Terms

All fees for the Services are due and payable as communicated to the User. Payments made once services or document processing activities have commenced are non-refundable, unless otherwise expressly agreed in writing. Fees charged by universities, governmental authorities, embassies, testing centers, couriers, or translation services remain the sole responsibility of the User, unless otherwise expressly agreed in writing. Failure to remit payments in accordance with the agreed terms may result in the suspension or termination of the Services.

  1. Protection and Processing of Personal Data

The Company collects, stores, processes, and, where necessary, transfers Personal Data for the purpose of providing the Services, including disclosure to universities, authorities, and trusted partners involved in the application process. By requesting and using the Services, the User provides explicit consent to the processing of such Personal Data for the purposes of admissions facilitation, related administrative operations, marketing communications where consented, and other lawful operational purposes. The processing of Personal Data is conducted in compliance with Moroccan Law 09-08 and any other applicable legal framework. Personal Data may be retained for the period required to achieve the purposes for which it was collected and for any additional period necessary to comply with legal obligations, resolve disputes, or serve legitimate operational interests. The Company implements reasonable technical and organizational measures to protect Personal Data against unauthorized access, disclosure, alteration, or destruction.

  1. Use of Anonymized Data

The Company may generate anonymized, non-identifiable data derived from Personal Data. Such anonymized data may be used, shared, or commercially exploited for analytical, research, statistical, or commercial purposes without additional consent, provided that it cannot reasonably be linked to the User or used to identify any individual.

  1. Rights of the User Regarding Personal Data

The User may, within the limits established by applicable law, request access to their Personal Data, request corrections where such information is inaccurate, or request deletion where the retention of such data is no longer required for legal compliance or legitimate operational purposes. All requests shall be handled in accordance with Moroccan law and the Company’s Privacy Policy.

  1. Intellectual Property

All materials, methods, content, documents, platforms, and know-how provided by the Company remain the exclusive intellectual property of Horizon Studies. The User agrees not to copy, reproduce, distribute, publish, or otherwise exploit such materials without the Company’s prior written authorization.

  1. Communication and Notifications

The User consents to receiving communications from the Company through such means as email, telephone, web platforms, and electronic messaging. The User may opt out of receiving promotional content, but shall continue to receive essential communications necessary for the provision of Services, including administrative, legal, or operational notifications.

  1. Cookies and Online Tracking

The Company may use cookies or similar technologies on its website or digital platforms. Users are informed of such practices through the Cookies Policy, and consent mechanisms are provided to manage the collection and processing of such data.

  1. Limitation of Liability

The Company shall not be held liable for any decisions, actions, or omissions of universities, governmental authorities, visa offices, or other third parties. The Company shall not be responsible for any indirect, incidental, consequential, or financial losses incurred by the User. In the event the Company’s liability is established by applicable law and solely attributable to proven fault, such liability shall be limited to the amount paid by the User for the specific service giving rise to the claim.

  1. Indemnification

The User agrees to indemnify, defend, and hold harmless Horizon Studies from and against any and all claims, liabilities, losses, damages, or expenses arising from the User’s misuse of the Services, submission of false or illegal documents, or breach of these Terms.

  1. Force Majeure

The Company shall not be liable for any delay or failure to perform its obligations under these Terms resulting from events beyond its reasonable control, including but not limited to natural disasters, armed conflicts, strikes, governmental restrictions, pandemics, cyber incidents, or other events constituting force majeure.

  1. Modification and Suspension of Services

The Company reserves the right, at its sole discretion, to modify, suspend, or discontinue any Services, or to amend these Terms at any time. Continued use of the Services following such modifications constitutes acceptance of the amended Terms. The Company may also suspend or terminate access to Services where the User fails to comply with these Terms or engages in conduct deemed harmful, unlawful, or detrimental to the Company or other Users.

  1. Recordkeeping

Electronic records, including emails, submitted forms, and agreements, shall constitute valid, binding, and admissible evidence for all purposes under these Terms.

  1. Dispute Resolution

Any dispute arising out of or in connection with the interpretation, application, or execution of these Terms shall first be submitted to mediation in the Kingdom of Morocco. Should mediation fail to achieve a resolution, the matter may be brought before the competent courts of the Kingdom of Morocco. To the extent permitted by law, the User expressly waives the right to initiate collective or class actions.

  1. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any legal action or proceeding, if necessary following mediation, shall fall under the exclusive jurisdiction of the Moroccan courts.
